The Necessity is the Mother of "Emergency!!"

"The Necessity is the Mother of Emergency!!".It is absolutely true.Whether in India or in our neigbour country Pakistan,the promulgation of emergency in their respective countries,by the powers that be, have always been prompted by personal motives.

Recently,Pakistan General Musharaf,when he wanted to contest for the post of presidentship and realising that he might face problems from the judiciary, especially from the Supreme court of Pakistan and the lawyers community, he simply clamped down emergency,by curtailing all civil rights of the people,confining the chief Justice of the Supreme court of Pakistan,the all opposition party leaders like Imran Khan, Bhutto and others to imprisonment or house arrest.Deported the former Prime Minister back on his arrival from the airport of Islamabad.Held the election in a very peaceful and congenial atmosphere !Got himself easily and safely elected as the president, without any opposition from any quarter.And also got his election declared valid by his own newly appointed judges of the Supreme court of Pakistan.When US pressurised him to lift the emergency and restore democracy and Commenwealth of Nations, expelled Pakistan, from its conglomoration,he wilted under presssure, announced elections, released the opposition party leaders and also appointed a specific date for the lifiting of emergency.However, only former Prime Minister Bhutto alone has been permitted to file her nomination papers for the forthcoming election and saw that the nomination papers of another former prime minister, carefully rejected as invalid.

Similarly, emergency was imposed in Pakistan in the year 1965 and 1967,when Pakistan was at war with India.

When we take the case of India, articles 352 to 356 of our constitution are governing the provisions of emergency.In the year 1971, when India was involved in the Bangladesh war and again in the year 1975,emergency was imposed in India.Particularly, our former Prime Minister, Mrs.Indira Gandhi,imposed emergency in the year 1975, when her election to the Parliament, was declared null and void by Justice Sinha of Allahabad High Court.We all know about the excesses committed during the emergency and in the end it was the political will and power of the people of India, saw Mrs.Gandhi, routed in the general election held in the year 1977 and the Janatha Party came to power mainly relying upon the excesses committed by her during the emergency.

Therefore,We generally feel that the emergency provisions contained in our constitution should not be misused for the personal gains of any politician in a democratic country like ours!!
