Judiciary-The Only Hope

The executive, judiciary and the legislature are three pillars of a democratic state. In order to run affairs of the state smoothly each pillar is bound to play its due role. Problems come to surface when one institution plays the role of a nosy parker in the affairs of its counterparts. The legislature frames laws while the executive implements them to govern the country. The judiciary plays the role of a supervisory body by keeping a sharp eye to note down that whether laws are framed and implemented for the welfare of the public according to the constitution. It is bound to dole out justice when there is infringement of rights of any person or organization. Thus judiciary is the last ray of hope for the sad sacks.

The judicial crisis in Pakistan entangled the regime in its self-created trap. The suo motu notices of the CJP Iftikhar Muhammad Chaudhary annoyed the establishment; therefore, they hatched conspiracies to make him non-functional. Subsequently lawyers’ community united with him and vehemently protested for his reinstatement. Some leading lawyers truly prove their mettle by stepping into the shoes of the father of the nation. They sacrificed their personal preoccupations over national imperatives. They did not earn a single penny from this justified case but won hearts and minds of millions. The honorable CJP was provided red carpet welcome wherever he visited that speaks volumes that the people are fed up with gross injustices. Now they want a positive change that can shape their national fate. Therefore, they pinned great hopes with the movement launched for independence of judiciary.

Various drastic steps by the men in the driving seat to suppress the unprecedented movement complicated the already grim situation in the country. Some of the political parties spin the outcome of judicial crisis in their own favor. Some inept people highlighted that there is clash between various institutions. They have failed to understand that a state is like a viable body while its institutions are like its organs. Therefore, clash of institutions would be suicidal. The guidepost decision of the full bench of the Supreme Court to reinstate CJP was a positive step towards sovereignty of judiciary. Now time is fully ripe for independence of judiciary, supremacy of the constitution and establishment of democracy to make progress in the welter the contemporary melting pot.
